Wherein I refer to one particular attorney as a “worthless piece of garbage.” Need I say more?

A few weeks ago, I did an episode of Lehto’s Law about !!!error: Indecipherable SUB-paragraph formatting!!! And the peanut gallery was wont* to ask, “Are there not bad attorneys as well, sir?”

Pray tell, yes . So I give you bad attorneys I interacted with personally. One was disbarred, another was fined (and had to give me the money), one was suspended for three years after I testified against him and the last was disbarred and thrown in jail. Good times.

Maybe off topic, but I have a question going back to one of your other podcasts about ticket myths. My wife recently got a speeding ticket out in west Texas, and we’d like to get the offense reduced if possible. How do you go about finding a good lawyer in another city, especially a small one like in Sonora, Sutton county?

Keep up the good work, I really enjoy all your posts and learn quite a bit each time.

With tickets, getting a LOCAL one is usually the most important part. Call a few (do a google search) and ask how often they are in that court, what do they charge and what do they think likely outcomes will be. Then just go with your gut.

Opposing counsel and his client sued my client for breach of contract. After a few months, they then added me to the complaint because I had the nerve in our counterclaim to specify all the bad things that the plaintiff had done. Judge tossed their amended complaint and sanctioned the lawyer, but now I always have to say yes on any applications or forms that ask if I’ve ever been sued. We ultimately got a $2m+ judgment against the plaintiff though, so that was fun!

I have a nerdy question you’ve probably answered or get asked a lot Steve, but...

If you were going to buy a new car for the first time, which state gives the consumer the most protection? Does it change for buying a used car?

I seriously am debating buying my new car in Michigan if for no other reason than to have you as an attorney and because it seems like there are laws that favor the consumer.

Yeah, no kidding, we saw so many cops on I-10. This one busted her when she was passing an 18 wheeler, and I think his speed reading was off, but he wasn’t having any of it and wouldn’t budge at all. Even told him it was our honeymoon, didn’t batt an eye and still gave us the ticket with no comment.

I’m just happy that my expanded vocabulary as compared to the average person meant that I didn’t need to look that up, as it was already correct.

I can also hear my attorney friends saying: “Worthless piece of garbage? Why on earth would you give him such a glowing endorsement?”

It’s one of those things that when you know, you know. You also know that there is no way to actually describe how bad it really is.

(I’ll stop now before this descends into a Chretienesque statement. I’m sure you know which one I am referring to, about proofs.)

Texas has a state law that allows dismissal if one takes a defensive driving course (on line) and has not had a ticket in one year. Alternatively, look for a lawyer named Sutton. There are lots of Suttons out there, some are probably lawyers. The JP may be a Sutton, too.

I’m kind of a neophyte when it comes to knowing anything about old gear like that, but I’ve always liked the sound I’ve heard out of some of the older styles of microphone. I have about 20 old mics and those are my favorite 6. They work but I don’t use them. I use a Blue Nessie for the podcast and a cheap lavalier for the video. The Nessie is fabulous and to use the others I’d have to get a board and some other stuff which I haven’t gotten to yet.

I worked in radio for a long time and have used Shures, EV Re-20s and the famous Sennheisers. My favorite was always the Re-20. They cost about $400 and I might spring for one one of these days.

Holy crap, just started looking into lawyers out there, and didn’t find any for that county (how’s that possible? seems like great market for somebody). Doing google searches for Sutton County traffic lawyers is not yielding good results. There are lawyers who say they service the area, but the closest ones I can actually find are in Abilene, Odessa, and San Antonio...

That whole area is known for being a big BS speed trap.

Steve thanks for the advice, but I might need your help busting up this farce of a system out in Sonora/Sutton county. Seems they like to catch out of towners and hike up the “clocked” speeds.

There are some rural areas where you might be better served to get an attorney from the nearby urban center. I am not familiar with the lay of the land in TX but a little research should turn up someone who handles a lot of tix in that jurisdiction.

Might I also recommend, before committing to anyone, that you do a quick check of the website of whatever entity regulates lawyers in Texas (usually the state supreme court in other states) just to make sure the lawyer you found hasn’t been dinged for any ethics violations. You don’t want to hire a drunk who regularly forgets to show up in court at the designated time.

No, I love the Nessie but it will not work with my camera. So I run a separate mic into the camera. I have tried synching the Nessie with the video and it looks OK but it is a hassle. A few times I have had the recording fail (and also the audio on the video fail) so I have done it each way - but I just do both as sort of a failsafe.

Great stories!

I have worked in the county tax collector/recorder/assessor’s office for over a decade. I started in the tax collector/recorder office working in the Unsecured division - this was people who were delinquent with taxes. It also included boat and business owners (boat owners are horrible about taxes - but that’s another story).

My job, in addition to all of the delinquent stuff and business taxes, I had to file claims for taxes and penalties for chapter 7, 11 and 13 bankruptcies. Typically, there is a window of time to get the amount claimed to court. If you miss this window you’re out of luck. Since government agencies are a top priority (we get paid first and never settle), this was important to us.

The person who files for bankruptcy has to inform the court of all of the liability or debt, and those people or entities need to be notified in order to claim. This includes bills, mortgage, taxes, etc. The amount owed is also reported by the person filing. The court then send out notices saying you can file a claim, and here’s the claimed amount reported to the court.

I once got a claim form for someone who owed back taxes, and the claim form report was in the amount of $500. This was not the exact figure but let’s say it’s not close to the full amount - closer to $5,000. So I file the claim for the full amount plus penalties up to the date they filed for bankruptcy.

Later I get a call from the attorney handling the bankruptcy, asking why I filed such a high amount. I ask him “where did you get the amount of $500?” The Attorney states “the client told me.” LONG PAUSE. I think I may have LOL’d at the phone. Long story short - my claim was sent with proof of the debt and penalties - and told the attorney that he may want to check the other claims as well (I’m sure he was hoping the under-reporting of the debt would be missed by others as well).

After I left the tax collector I started at the Assessor’s office appraising real property. One department I worked in dealt with ownership issues. I’ve got plenty of stories about bad legal advice when it comes to real estate. Like “it’s not a new home but a remodel if you leave a small portion of one original wall up when building a new home.”

Lets just say that when I hear “well, I’m going to get a lawyer” from someone, I reply “make sure they are a real estate lawyer, most regular lawyers know squat about real estate.”

As a former law student who, along with many of my peers, graduated into 0 jobs, I’ll also give you some advice: go to law school if you have a very concrete, realistic idea of the type of law you want to do. Want to become a DA or a defense attorney? Great. Most of my peers who were so focused found jobs that don’t pay super well and have long hours but they get to do what they went to law school to do. Want to make $150,000/year doing “business law stuff”? No so great. Those days are likely over.

“your fault” indicates that “you” (Steve in this case) is the subject of the sentence while “journalistic standards” and “editorial oversight” are the objects of the sentence being acted upon and described respectively.

...No, I’m afraid not. Let’s look at it again:

Therefore, the descent of journalistic standards and the dearth of editorial oversight on this site are not your fault.

Let’s ignore “Therefore” - forget the part of speech it is (maybe a conjunction? here), it’s not really relevant though.

We have “descent of journalistic standards” and “dearth of editorial oversight”. When you see “of”, that indicates a prepositional phrase. Those prepositional phrases are *modifiers* to the main subjects - which are “descent” and “dearth”. “Are not” is the verb phrase here, and “fault” is the object (“your” being the modifier clarifying *whose* fault). Grammar-wise, “you”/Steve is in no way the subject of that sentence (although it is being addressed to him).

I’d diagram the sentence, but I can’t find a good tool that isn’t more effort than it’s worth. :P

Well, it depends. I’ve had people freak out over the smallest things. I try to write well but typos happen. If you spot a typo and feel like taking the time to point it out, great. Not sure what that gains anyone. But try to keep your response proportional.

It ain’t the end of the world.

I’ve also had people point out typos that weren’t. I was keeping a list for a while but then it got too cumbersome. Like the moron who told me “balk” was misspelled and should have been “baulk.” I call him a moron because a simple check online would have revealed my spelling is the accepted version in the US. Where I reside.

And if you make a mistake when pointing out a “mistake,” all bets are off. As noted above. (And no, that guy never responded after I pointed out that I was right and he was wrong.)

And there, too, the dictionary vindicated me. While “Babushka” may mean “grandmother” in RUSSIAN, it has been adopted in English to mean the headscarf worn by the little old lady, not the little old lady herself.

That was an example of someone who just wanted to convince the world that he/she was smarter than everyone else. Which obviously was not true.

Which side of insurance? I interviewed at an insurance defense firm and it was soul-sucking (the interview, not even working there). Maybe not all insurance defense firms are like this, but I’d check around, see if you can visit one, meet with people. It’ll give you a good feel.

I am a member of the bar, but I don’t practice law and thus don’t carry insurance (required in my state). One of the neat things (for me in my area) is a charitable organization that provides insurance if you do pro bono work for senior citizens at a local senior center. I found that really interesting (and depressing, because most were indigent). Law students would volunteer there as paralegals. But it was a neat way to get acquainted with elder law without committing to it.

I would see if there are similar opportunities in your area that you could at least check out, even if for two hours a month, to see how it feels. Better to do that than after $X in debt. (I decided second year of law school that I didn’t want to be a lawyer and now do public sector labor relations. But many of my friends went on, eventually, to practice law).

In the area that I live in, there is one elder care attorney in the state and he gets clients from all over the state and is very successful and good at what he does. The demand for it is extremely high and it is not something a lot of people have thought about around here. Most lawyers in my city are injury lawyers.

Hey Steve I have a quick question if you read this me and my friend were wondering if some has a car that has a loan on it is customized and gets repossessed do they give him back when he spent on it do they sell it and put it to his loan or what ? If your not sure I appricate it hopefully someone who deals with this sees it.
